Analytical Review of the Draft Law about mobing

A draft law was submitted to the Verkhovna Rada of Ukraine to amend the Code of Ukraine on Administrative Offenses, the Law of Ukraine “On Principles of Preventing and Combating Discrimination in Ukraine” and the Law of Ukraine “On Collective Agreements” by defining the term «mobbing», As well as by establishing administrative liability for the systematic application of various forms of mobbing to the employee. Thus, the bill aims to protect all participants in labor relations from various forms of mobbing and establish administrative liability for such actions.

The draft law proposes to add Article 173-5, which contains a definition of “mobbing”, namely: “mobbing – the actions of participants in labor relations, which are psychological, physical, economic violence, including the use of electronic communications committed against an employee of the enterprise, institution, organization, regardless of ownership, type of activity and industry affiliation, as well as persons working under an employment contract with individuals or persons working under an employment contract with individuals concerning other participants in employment to humiliate their human dignity on certain grounds, creating a tense, hostile, offensive atmosphere towards them and/or forcing the participant of labor relations to change the place of work “.
