“Report on the results of monitoring of judicial practice in the field of mobbing” was presented live.
🔘The author of the material, intern of the Analytical Center JurFem Karina Litvinyuk told about how she identified cases for monitoring:
📢 ”I recorded 130 lawsuits during 2011-2021, where employees filed lawsuits because they were illegally fired or disciplined, and one of the reasons for the appeals was also called psychological violence.
Interestingly, I discovered such cases using the words “mobbing” and “harassment”. Although mobbing is a word of foreign origin, it is actively used in national court practice, and in many cases, the court even gives an interpretation of what “mobbing” is, – says Karina.
Kateryna Shvets, a lawyer with the Labor Initiatives NGO, and Dmytro Shvets, a lawyer, Ph.D., partner of ELAW Law Firm, and Chairman of the Labor Law Committee of the Lviv Region Bar Council, also took part in the discussion. The conversation was moderated by Kateryna Shunevych, a lawyer and head of the Analytical Center JurFem.
