Reproductive rights: the limits of state intervention in women’s privacy

The reproductive rights concern the private interests of individuals in planning a family, giving birth or, conversely, refusing to have children. Analyzing women’s interests directly, reproductive rights also address issues such as the ability to make decisions about one’s own body and sexual and reproductive health.

Whereas reproductive rights contain a moral and ethical aspect in the context of matters of public morality, ethical values and private interest, which is linked to the right to privacy, therefore, the state may interfere in the privacy of individuals, including women. However, such intervention must meet certain requirements so that the balance between public and private interests is not disturbed.
